This course focuses on Licensing of Private Recruiters and Monitoring and Enforcement of Recruitment Regulations.
OBJECTIVES
More specifically, the Course aimed to:
• enhance familiarity of officials responsible for regulating recruitment with ILO’s General Guidelines and Operational Principles for Fair Recruitment and Definition of Recruitment Fees and Costs;
• impart good practices and have an exchange of views with respect enforcing regulations and monitoring/inspecting compliance, the requirements for licensing recruiters, the acts that laws prohibit, and the sanctions they impose for violations; and effective complaints mechanisms;
• discuss the development of regional guidelines with respect to monitoring recruitment processes; establishing effective inspection; and acting on complaints.
CONTENT
The course is comprised of 3 modules:
Module 1: Introduction to the ILO Fair Recruitment Guidelines; and Licensing of private recruiters
• ILO Fair Recruitment General Principles and Operational Guidelines including definition of recruitment fees and related costs
• General policy on private sector participation in recruitment
• Qualification requirements, their objectives and rationale;
• Financial guarantee requirements
• Foreign participation
• Examples of good practice, “carrots and stick” approach
Module 2: Monitoring recruitment processes and establishing effective inspection
• Monitoring, inspections and other information sources
• Inspectorate : dedicated personnel, training, SOPs
• Prohibited acts and recruitment practices
• Regulatory powers/sanctions
• Prospects for digitization
Module 3: Acting on Complaints
• Complaints mechanisms and procedures
• Support services
• Case studies
• Legislative mechanisms for prosecuting unfair recruiters
